Anyone wishing to proceed with a claim should note that:
a. The VAT element of our fee cannot be reclaimed from your debtor;
b. Interest and compensation may take the debt into a higher banding with a higher cost;
c. The costs quoted are not for matters where enforcement action, such as the Bailiffs, is needed to collect your debt;
d. In an undisputed claim, you can only claim the debt, interest, court fees and a nominal amount of costs.
Our fee includes:
a. Taking your instructions and reviewing documentation;
b. Undertaking appropriate searches;
c. Sending a letter before action;
d. Receiving payment and forwarding to you, or if the debt is unpaid, drafting and issuing claim;
e. Where no acknowledgement of service or defence is received, applying to the court to enter judgment in default;
f. When judgment in default is received, write to Defendant to request payment;
g. If payment is not received by the date shown on the judgment, providing you with advice on the next steps and the likely costs.
Matters normally take between 4 and 18 weeks from receipt of instructions from you to receipt of payment from the Defendant, depending on whether or not it is necessary to issue a claim. This is on the basis that the Defendant pays promptly on receipt of the judgment. If enforcement action is needed, the matter will take longer to resolve and may include increase costs.
